Sub : Ultimatum to Airlines
It is regrettable that, in spite of the various reminders ending with the 7th May letter to the 16 Respondent Airlines and the 13th May letter to DGCA, the erring Airlines have not responded and the status quo remains.
As the Petitioners, in our opinion, the Law of the Land stands challenged in the hands of 16 foreign Airlines.
We have warned these Airlines individually (a copy attached) that such non-compliance of the provisions of Rule 135, being a Category IV offence, is punishable with imprisonment of a term not exceeding 3 months or with fine not exceeding one lakh Rupees or with both vide MoCA Notification G.S.R. 686 (E) dtd. 17th September, 2009. We have also cautioned them that they are in contravention of the undertaking given to DGCA while executing the Bilateral Services Agreement.
Hence, we have requested the Airlines to pay commission @ 5% on Gross fare, with effect from 5th March, 2010, and given them a week’s time within which to respond. failing which IAAI would be forced to move DGCA and the Judicial Authorities of the land to enforce lawful commission.
We once again request all Agents, like-minded Associations and the related Trade Organisations to support us.
